What is PoSH Training?

PoSH training for employees helps them identify and differentiate between appropriate and inappropriate behavior in the workplace. It also educates participants on the legal aspect under the PoSH (Prevention of sexual harassment) act.

Why is POSH training important?

POSH training is important to create awareness among the employees at workplace. It helps in creating a safe and secure work environment for the women at workplace.

Is POSH training mandatory?

Creating awareness among the employees about prevention of sexual harassment of women is mandated by the POSH act. That makes POSH training mandatory.

How often should posh training be conducted?

Conduct regular sexual harassment awareness programmes and workshops with the provisions of the POSH Act: The POSH Act requires every employer to organise periodic sensitisation workshops for all their employees. It is advised to conduct POSH training for employees and managers once a year.

What is POSH policy?

The POSH Act- Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) 2013 was enacted to protect women from sexual harassment and provide a safe and secure work environment.

What is ICC in POSH?

ICC- Internal complaints committee (Now referred to as Internal Committee/IC) was introduced as a feature by POSH Act 2013. Every organization should have an IC, which registers the complaint and investigates it with fairness and justice.

Is PoSH civil or criminal?

The Act gives the IC the same powers as are vested in the Civil Court under the Code of Civil Procedure, 1908 (“CPC”), limited to summoning and production of documents.

This 2012 Indian law protects children from sexual offenses. It covers a range of offenses, including: Penetrative sexual assault, Non-penetrative sexual assault, Pornography, Exhibitionism, Stalking. Sexual harassment, Abetment of child sexual abuse .

  • POCSO puts the burden of proof on the accused rather than the victim. The onus is on the accused to prove that he/she is innocent rather than on the child to prove that the crime took place.
  • POCSO is gender neutral when it addresses the victims and the accused.
  • POSCO addresses a comprehensive spectrum of criminal sexual offences that includes various forms of (partial) penetrative offences, non-touch forms of abuse, pornography, exhibitionism, stalking etc.
  • POCSO takes into account power dynamics in relationships between the victim and the accused. The vulnerability of the victim and the position of accused play a major part in the prosecution of the crime.
  • POCSO provides for child-friendly measures, procedures and infrastructure to ensure minimum trauma is visited upon the child during the judicial process.
  • POCSO regards Child Protection as a collective responsibility. It makes the reporting of cases mandatory for every citizen. It also lays out guidelines for all duty-bearers and stakeholders who interact with the child victim and the case.
